공감

A great deal of uncertainties and threats triggered by COVID-19 are now affecting every corner of people’s lives, and human rights are no exception. GongGam is joining forces with other human rights organizations in order to shed light on human rights stained with discrimination and hatred, and to ensure human rights-guaranteed life for all.

 [Human Rights of the Disabled]

Out of 102 patients in closed wards of Daenam Hospital in Cheongdo in North Gyeongsang Province, 100, or 98%, tested positive for COVID-19, and 7 of them died. The fact that confirmed cases gushed out of the psychiatric hospital demonstrates that not only efforts to control infection and to maintain good sanitation were not made, but also disabled people have been in the blind spot of sanitary control. In this regard, GongGam, in cooperation with associations of the disabled, asked for the government to provide an emergency fund. GongGam will continue to deliver the voices of mentally-challenged people and call for government actions so that those who are in mental hospitals can secure their lives and health.

[Human Rights of Vulnerable Workers]

A growing number of workers are forced to take unpaid leave. are fired without notice, or have less work than before due to an economic slump led by COVID-19. In particular, temporary workers and low income people have been hit the hardest. GongGam, to help those who are having difficult times these days, has recently become a member of a special team designed to mitigate issues created by COVID-19 called Gapjil 119, an organization to fight against Gapjil(superiors at work who gives their subordinates hard times with an arrogant and authoritarian attitude or actions), and has given legal support for workers who have lost their jobs and undergone hardships. GongGam, along with Gapjil 119, will make its best efforts to let the voices of workers who are excluded from the government’s aid resonate through the media and the government come up with measures to support them as well.

[Human Rights of Immigrants]

 Many human rights advocates for immigrant workers, including GongGam, issued a joint statement on March 6th, 2020, criticizing the current policies which only focus on its nationals. Although many of the immigrants residing in South Korea are covered by the national health insurance system, they are required to present a health insurance card to buy public masks distributed by the government. Furthermore, the government neglects its duties to provide necessary multiple-language information for immigrants. As everyone can be infected with the pandemic, regardless of race, nationality, and status of stay, inclusive and comprehensive measures should be made to overcome this crisis. This is not just confined to the virus. People, irrespective of nationality and race, can encounter many dangers in the society- for example, accidents, diseases, and aging. Therefore, GongGam will keep on working to ensure health rights of immigrants

[Poverty and Welfare]

Recently, some self-sufficient shelters for the homeless notified that under the pretext of effective response to COVID-19, those who find a job and go to work are no longer eligible to stay in the shelters. Many homeless people working to stand self-sufficient, just overnight, were kicked out on the streets. Amid the national health crisis, homeless support systems which are already poor in providing residential places, medical services, and meals, are now forcing the homeless out to live in poorer conditions. In response, GongGam, with anti-poverty groups like Homeless Action and Korean People’s Solidarity Against Poverty, urged the National Human Rights of Korea to order homeless residential facilities to stop violating human rights of homeless people and to come up with emergency measures. GongGam will always stand with them so that they will not be excluded nor discriminated.

[General Public Interest Law – Disaster]

GongGam has kept supporting victims of the Sewol Sinking since April 16th, 2014. During the MERS outbreak, it also requested the government to improve response systems to infectious diseases by speaking out the need to change public awareness of quarantine, related requirements and procedures, treatment of non-quarantined people. When it comes to COVID-19, GongGam will proactively work together with the National Bar Association’s TF for those who are affected by the pandemic to provide legal consultation for confirmed patients and non-quarantined people, to fix discrimination against the socially-vulnerable, and to improve related policies

공감이 코로나19를 마주하는 법 

코로나19로 인한 다양한 모습의 불안과 위협이 우리 삶에 영향을 미치고 있는 이 때, 공감이 만나는 인권의 문제들 또한 코로나19로부터 예외일 수 없습니다. 공감은 차별과 혐오 속에 방치되고 있는 인권을 드러내고 모두를 위한 안전한 삶이 보장될 수 있도록, 다양한 인권 분야의 여러 단체들과 힘을 모으고 있습니다.

[장애인 인권]

경북 청도 대남병원 폐쇄병동 입원자 102명 중 100명이 코로나 19 바이러스 확진 판정을 받아, 폐쇄병동 입원자 중 98%가 코로나19에 감염되었고, 이중 7명이 사망하였습니다. 코로나19 확진자가 정신병원에서 쏟아져나온 것은 정신병원 내 감염관리나 위생 통제가 전혀 이루어지고 있지 않고, 보건 관리의 사각지대에 있음을 의미합니다. 이에 대해 공감은 장애인단체들과 연대하여 국가인권위에 긴급구제신청을 하였습니다. 앞으로도 공감은 전국의 정신병원에 입원되어 있는 정신장애인이 코로나19 바이러스 감염으로 인해 생명 또는 건강에 심각한 피해가 발생되지 않도록 정신장애인들의 목소리를 알리고 정부의 대책을 요구하겠습니다.

[취약노동]

코로나19로 인한 경제 침체 상황에서 일방적으로 무급휴직과 해고를 당하거나 일감이 끊기는 노동자들이 속출하고 있습니다. 일을 하지 못하면 당장 먹고 살기 힘든 비정규직, 저소득노동자들이 무방비상태에서 가장 먼저 직격탄을 맞고 있습니다. 이에 공감은 직장갑질119가 주도하는 코로나대책반에 참여하여 생계가 끊긴 노동자들을 위해 법률지원 활동을 하고 있습니다. 공감은 직장갑질 119와 함께 정부의 코로나19대책에서 배제된 노동자들의 목소리를 언론을 통해 알리고 정부에 대책을 요구하는 활동도 이어가겠습니다.

[이주민 인권]

공감을 포함한 이주인권단체들은 2020. 3. 6. 성명을 내어 한국 체류 이주민 중 상당수가 건강보험에 가입되어 있지 못함에도 공적 마스크 구입에 건강보험증 제시를 요구하거나 이주민의 언어장벽을 고려한 체계적 다국어 정보제공을 해태하는 등 각종 대책에서 이주민을 배제하는 정부정책을 비판하고, 전염병은 사람의 인종, 국적 또는 체류지위를 가리지 않으므로 모두를 포함하는 평등한 대책만이 코로나19 극복의 지름길이 될 것임을 지적하였습니다. 바이러스만은 아닙니다. 사고, 질병, 노화 등 사람의 생애 동안 발생할 수 있는 사회적 위험은 국적과 인종을 가리지 않기에 공감은 이주민의 건강권 보장을 위한 활동을 이어나갈 계획입니다.

[빈곤과 복지]

최근 노숙인자활시설에서 코로나19 대응이라는 이름으로 시설생활인들에게 직장에 출근하는 경우 출입을 금지한다고 통보하였습니다. 자활을 위해 일을 하던 홈리스들이 하루아침에 길거리에 쫓겨나게 되었습니다. 코로나19 사태라는 국가적 재난 상황에서 주거, 의료, 급식지원이 부실한 홈리스지원체계가 홈리스들을 더 열악한 상황으로 내몰고 있습니다. 이에 공감은 홈리스행동, 빈곤사회연대 등 반빈곤운동 단체들과 공동으로 국가인권위에 노숙인복지시설의 인권침해 중지 및 대책 마련을 촉구하는 긴급구제 신청을 하였습니다. 공감은 코로나19 대응에서 홈리스들이 배제당하고 차별당하지 않도록 함께 노력하겠습니다.

[공익법 일반 – 재난]

공감은 4.16 세월호 참사 이후 지속적으로 재난 피해자들을 지원해왔고, 메르스 때도 격리에 대한 인식, 요건과 절차, 피격리자 처우에 대한 문제제기를 통해 일부 제도 개선을 이뤄낸 바 있습니다. 코로나19와 관련해서도 대한변협의 코로나19대책법률지원TF에 적극 결합하여 확진자, 피격리자에 대한 법률상담, 사회적 약자에 대한 차별 시정, 특별 조치 등 제도개선 등에 나설 계획입니다.
