Four members of GongGam—Ji Yoon Kang, Eunhee Kang. Jirim Kim, and Pillkyu Hwang—travelled to Geneva to attend the review (19-20 October) of the ROK’s fifth periodic report by the Human Rights Committee (CCPR). Since this July, GongGam has worked as part of the Korean NGO coalition for the CCPR review, submitting a joint shadow report (INT_CCPR_CSS_KOR_56073_E)of 119 Korean NGOs and preparing various lobby documents for the review. Formal and Informal NGO Briefing Sessions

Our first official schedule was the Formal NGO Briefing session for the Human Rights Committee on 16 October (Monday). Here, we had the opportunity to meet the Committee Members for the first time and to address them along with other civil society activists. Members of GongGam explained to the Committee the domestic human rights situation—Eunhee on business and human rights, Jirim on refugee and migrants’ human rights, Pillkyu on the freedoms of expression and assembly—and conveyed the demands from the Korean civil society.

Shortly before the review session on 19 October (Thursday), we also attended the Informal NGO Briefing session organized by the CCPR Centre. This is where the Committee Members can ask questions to civil society representatives and receive answers. The Committee Members asked quite detailed questions, showing they had carefully read the civil society shadow reports, and GongGam members provided detailed answers, so that this may lead to questions for the government during the actual review.

Public Rally

“How about holding a public rally in front of the UN Office in Geneva?” The suggestion came during a meeting just about one month before the trip. Upon learning that public rallies need to be reported a month in advance, I rushed to the Canton of Geneva website to report the rally. After ID verification over the phone and two further emails confirming the purpose and format of the rally, the permit document arrived only two days before our departure.

In the rainy morning before the CCPR review, Korean civil society activists and labour rights activists based in Geneva gathered in front of the Broken Chair sculpture across from the UN Office. Holding pickets on our respective issue areas, such as “Freedom to choose one’s own workplace,” “Stop Repression on Civil Society,” and “No Impunity for Corporate Abuse,” we denounced the regression of civil and political rights in the ROK.

Meetings with UN Human Rights Council Special Procedures

While attending official events related to the CCPR review, members of GongGam also made time to meet special people whom we can only meet Geneva. We met with officers supporting the UN Human Rights Council Special Procedures and from the Office of the UN High Commissioner for Human Rights (OHCHR) that work on our respective issue areas, as well as NGO activists based in Geneva. Through these meetings, we explored the possibility of collaboration on specific on-going cases related to the ROK and also obtained information on various remedial mechanisms available under the UN human rights system.

Jirim met with an officer supporting the Independent Expert on sexual orientation and gender identity to discuss the discrimination against sexual minorities in the ROK. Jirim and Pillkyu met with an officer supporting the Special Rapporteur on freedom of religion or belief to discuss the racist and Islamophobic acts surrounding the mosque construction in Daegu, as well as an officer supporting the Special Rapporteur on the human rights of migrants to discuss refugee rights. Ji Yoon and Pillkyu met with an officer supporting the Special Rapporteur on the independence of judges and lawyers to discuss the judicial abuse of power case. They, along with Eunhee, also met with an officer supporting the Working Group on Business and Human Rights to discuss various cases currently monitored by KTNC Watch.

Eunhee also met with international activists from the International Trade Union Confederation (ITUC) to discuss strategies for the CCPR review and experienced the solidarity of workers across borders.

CCPR review

The consideration of the ROK’s periodic report by the Human Rights Committee took place on Thursday (19th) afternoon and Friday (20th) morning. The periodic report was divided into roughly two parts, and the session progressed in the order of questions by Committee Members, answers from the Korean government representatives, and follow-up questions and answers. Civil society representatives closely monitored the questions and answers throughout the session, and approached individual Committee Members during the breaks and before and after the sessions to explain various lobby documents previously submitted and point out problems with the government’s answers.

Through this process, issues such as the October 29 Itaewon Disaster, labour rights including damage claims for strikes, migrant’s rights including opposition to the mosque construction in Daegu, children’s rights including universal registration and anonymous birth, were emphasized and questioned. After each review session, we compiled and submitted our comments on the government’s answers during the session, after the conclusion of all sessions, we submitted a consolidated list of suggested recommendations, as well as distributing a press release in Korea outlining the progress so far.

The Committee’s Concluding Observations, which may be considered a report card on the ROK’s progress on the implementation of the Covenant, is scheduled to be released on the OHCHR website around 3 November. Along with the Korean NGO coalition, GongGam will review the Concluding Observations and engage in follow-up activities to ensure the recommendations are substantively applied in government policy.

제5차 UN 자유권규약위원회 대한민국 심의를 위한 공감 구성원 4인의 제네바 출장기

공감 강지윤, 강은희, 김지림, 황필규 변호사는 제5차 유엔 자유권규약위원회 대한민국 심의 대응을 위해 스위스 제네바에 다녀왔습니다! 공감은 올해 7월부터 한국 시민사회 자유권 대응모임에 함께 하며 119개 NGO 공동 보고서 제출하고(), 심의를 위한 각종 로비문서를 만드는 활동을 해왔는데요. 금번 제5차 유엔 자유권규약위원회 대한민국 심의를 위한 제네바 출장에서의 활동 아래에서 자세히 설명드립니다 🙂

NGO 공식/ 비공식 브리핑
공감 구성원들은 제네바 도착 후 첫 공식 일정으로 16일(월) 자유권위원회 ‘NGO 공식 브리핑’에 참석했습니다. 자유권 위원들을 처음 만나는 이 자리에서 다른 시민사회 활동가들과 함께 발언을 할 기회가 있었는데요. 강은희 변호사는 기업과 인권, 김지림 변호사는 난민과 이주민 인권, 황필규 변호사는 표현 및 집회의 자유에 대한 국내 상황을 설명하고 시민사회의 요구를 전달했습니다.
본 심의 직전인 19일(목)에는 현지 단체인 ‘CCPR 센터’에서 주최하는 ‘NGO 비공식 브리핑’에 참석했는데요, 한국 심의 담당 위원들이 시민사회에 궁금한 부분을 질문하고 답변을 받을 수 있는 자리였습니다. 위원들은 미리 제출한 시민사회 보고서를 꼼꼼히 읽어보았는지 상당히 구체적인 질문을 하였고, 공감 구성원들은 해당 내용이 실제 심의에서 정부에 대한 질문으로 이어질 수 있도록 각자 맡은 영역에 대해 성실히 답변하였습니다.

집회
“제네바에서 집회를 하는 건 어때?” 출장을 한달 앞두고 바쁘게 진행되던 회의에서 나온 아이디어였습니다. 집회를 하고자 하는 날로부터 한달 전에는 집회 신고가 되어야 한다는 이야기에 부랴부랴 제네바 시 홈페이지에 접속하여 온라인으로 집회 신고를 하였습니다. 유선전화로 신원확인을 하고, 그로부터 두 번에 걸쳐 집회의 목적과 방식을 확인하는 메일이 오고간 후 출장을 떠나기 이틀 전에야 확정적인 집회 허가 서류가 날아왔습니다.
자유권 심의 당일 비가 추적추적 내리는 가운데, 유엔 파빌리온 부러진 의자(Broken Chair) 앞 한국 시민사회 활동가들과 제네바 현지 노동인권 활동가들이 모였습니다. ‘Freedom to choose one’s own workplace(사업장 변경의 자유)’, ‘Stop Repression on Civil society(시민사회 탄압 중단)’, ‘No Impunity for corporate abuse(기업의 인권침해 처벌하라)’ 등 각자의 의제가 담긴 팻말을 들고 한국의 자유권 후퇴 현실을 고발하였습니다.

특별절차 미팅
구성원들은 자유권 심의의 공식적인 일정을 소화하면서도 시간을 쪼개 제네바에 가야만 만날 수 있는 특별한 사람들을 만났습니다. 각자가 주로 활동하는 영역의 유엔 인권특별보고관 또는 유엔인권최고대표사무소 오피서(실무자)들과 제네바에 있는 활동하는 NGO 활동가들을 만났는데요. 이들과의 만남을 통해 한국에서 진행하는 구체적 사건에 있어 국제적인 연대의 가능성도 탐색하고 유엔의 여러 권리 구제 매커니즘에 대한 정보도 얻을 수 있었습니다.
김지림 변호사는 한국의 성소수자 차별 사안 관련하여 성소수자 특별보고관 오피서, 황필규 변호사와 함께 무슬림 사원 건설을 둘러싼 인종, 종교혐오적 행위 관련 종교의 자유 특별보고관 오피서 그리고 한국의 이주노동자, 난민 인권관련 이주인권 특별보고관 오피서와 만났습니다. 강지윤 변호사와 황필규 변호사는 사법농단과 관련하여 사법독립성 특보를 만났습니다. 이 둘은 강은희 변호사와 함께는 기업과인권네트워크에서 진행하는 여러 사건에 대하여 도움을 얻을 수 있을까 하는 마음에서 유엔 인권최고대표사무소 기업과인권워킹그룹 오피서와도 만나는 시간을 가졌습니다.
강은희 변호사는 세계 곳곳에서 활동하는 국제노총(ITUC / International Trade Union Confederation)의 활동가들과도 만나며, 제네바 내부인들의 자유권 심의 대응 전략과 국경을 넘어서는 노동자들의 연대를 경험하였습니다.

자유권 규약 심의
자유권위원회의 한국 국가보고서 심의가 19일 오후, 20일 오전에 진행되었습니다. 국가보고서의 내용을 크게 두 부분으로 나눠서 위원들이 질문을 제시하고 한국정부 관계자가 답변을 하고 추가 질의응답이 이어지는 방식으로 진행되었습니다. 시민사회 대표단은 기본적으로 질의와 답변의 내용을 꼼꼼히 모니터링하면서 심의 전후, 쉬는 시간에 개별 위원들에게 다가가 기존에 제출된 전체이슈 요약문서, 개별이슈 정리문서, 추가 메모의 핵심내용을 설명하기도하고 정부답변의 문제를 지적하기도 했습니다.
이 과정을 통해 특히 10.29 이태원참사, 파업노동자 손배청구 등 노동인권, 대구이슬람사원공사반대 등 이주민인권, 보편적출생등록과 익명출산 등 아동인권 이슈들이 강조되어 질의되기도 했습니다. 매 심의가 끝날 때마다 당일 정부 답변에 대한 반박자료를 정리해 전달했고 모든 절차가 완료된 후에는 위원회에 권고내용을 제안하는 문서를 마지막으로 전달하고 그동안의 경과를 정리한 보도자료를 한국에 배포했습니다.

지난 8년간 한국의 자유권 규약 이행 성적표라고 할 수 있는 자유권위원회의 최종견해는 11월 3일 경 유엔 홈페이지에 공개될 예정입니다. 공감은 한국 시민사회 자유권 대응모임과 함께 최종견해를 검토하고, 정부 정책에 실질적으로 반영할 것을 촉구하는 후속활동을 이어가겠습니다.
